 Arizona on Tuesday filed suit against President Biden's vaccine mandate by arguing it is unfair because migrants at the southern border are not required to get the jab. 

Arizona Attorney General Mark Brnovich, who is running in a crowded GOP primary to unseat Democratic Sen. Mark Kelly, claimed the president is illegally favoring unlawful migrants, who are offered a jab but not required to take it.

Meanwhile, federal workers are required to get vaccinated and businesses with 100 or more employees must require a vaccine or a weekly Covid-19 test, according to Biden's order. Employers that do not comply could face a $14,000 fine. 

In the suit, the attorney general argued that the vaccine mandate violates the Equal Protection Clause of the 14th Amendment to the Constitution.

'This reflects an unmistakable -- and unconstitutional -- brand of favoritism in favor of illegal migrants.'

Undocumented immigrants, too, would be required to take the vaccine or adhere to the testing scheme if they seek employment.  

'The federal government cannot force people to get the Covid-19 vaccine,' Brnovich added. 'The Biden Administration is once again flouting our laws and precedents to push their radical agenda.' 


The attorney general of Arizona, which borders Mexico, asked a US District Court to declare the vaccination mandate unconstitutional. 

Brnovich's suit is the first of many expected challenges to Biden's new vaccine rules, which some Republicans have deemed unconstitutional. 

Asked last week about legal challenges to the strict new vaccination rules, a defiant Biden said: 'Have at it.'

The new vaccine rules for private employers will affect about 80 million workers in the US. 

Roughly 17 million workers at health facilities that receive federal Medicare or Medicaid also will have to be fully vaccinated, as will another approximately 2 million federal workers. Congress and their staff are not required to take the vaccine as they do not fall under the executive branch, and neither are workers in federal courts.
