 Police in Texas have launched an investigation into allegations that a black middle schooler was forced to drink urine and racially abused during a sleepover with a group of classmates last month.  

The Plano Police Department confirmed in a Wednesday statement that its officers are 'aggressively investigating' claims of abuse against eighth grader SeMarion Humphrey.

The announcement comes after SeMarion and his mother, Summer Smith, held a press conference outside of Haggard Middle School on Friday, demanding the classmates responsible be criminally charged along with their parents.


Calling the abuse 'pre-meditated' and 'racially motivated', Smith said her son has been bullied and harassed at Haggard on and off for the last two years.

However, the tyrannizing came to a 'horrifying' head on February 12, when SeMarion was invited to a sleepover by a fellow student - completely unaware that several boys who'd allegedly bullied him previously would also be attending, Smith said.

At the sleepover, Smith said her son was was taunted and called the N-word, in addition to a number of homophobic slurs. Some of the boys also shot SeMarion with a BB gun, she said.

A cellphone video was also shared to social media showing the young teen being forced to drink what appears to be urine in a cup, as several people can be heard snickering in the background. 

Another video shows SeMarion being slapped once while he's sleeping.

SeMarion didn't initially tell anyone about what allegedly transpired at the sleepover because his tormentors threatened to hurt him if he did, Cole said.


The boy didn't return to school until more than a week later, on February 22, because of the freak snowstorm, Storm Uri, which had battered the south of the US for several days prior.

However, the video of SeMarion purportedly drinking urine had been circulating on social media between his classmates during that time. 

After returning to school, one student asked him if he really had drank urine, to which he responded he didn't remember the incident because he'd take sleep aid medication for his anxiety that night.

Only last week did SeMarion inform his principal what happened during the sleepover, after school officials were made aware of the videos. The school then informed Smith.

In a video statement published last Thursday, the Plano Independent School District Superintendent Sara Bonser said, 'the district immediately launched an investigation.'

'Incidents like this affect our whole community. I want to let our community know that Plano ISD does not and will not tolerate bullying or harassment and believes every student must be treated with dignity and respect,' Bonser continued. 

In an additional statement to CNN, the district confirmed school officials are also working closely with 'all involved students and their parents'. 

'Since Plano ISD employs members of local law enforcement as school resource officers, the Plano Police Department was immediately involved,' the district said. 

Plano Police Chief Ed Drain has also met with SeMarion and Smith, describing the meeting as 'very productive', CNN reported.

In her Friday press conference, Smith lamented the Plano Independent School District, claiming they told her there was 'nothing they could do' and that Superintendent Bonser had ignored her calls.

'I found out it had happened two weeks prior,' Smith said at the conference, 'that the videos had been shared with pretty much the entire school.'

She continued: 'The school was laughing at him. Why is that not a school issue? We're passing around a video, during school hours. How is that not a school issue? The boys are on the football team, how is that not a school issue?'

SeMarion had previously gone to is football coaches to tell them of the bullying he'd been subjected to in the months before the sleepover, his mother claimed, only to be told 'boys will be boys', that he needed to have a 'tougher skin,' and that 'everybody is not going to like you'.

SeMarion was in attendance for Friday's press conference, occasionally needing to be consoled as he wept over the bullying, which his mom said had been happening on and off for two years

The Next Generation Action Network shared messages SeMarion sent one of the students on Snapchat where he chastised the group for making fun of him for taking medication and for saying that women should be 'raped'

Smith also asserted that the taped assault was 'premeditated,' describing how one of the boys only befriended her son in the hopes of getting him to the sleepover party.

'I told the principal this boy befriended my child, he sought him out,' she said. 'He spent several weeks with him, just the two of them, which led up to the birthday party sleepover where it was premeditated and obvious that SeMarion was only invited for their pure entertainment.

Smith continued: I want to also add that after it happened, he didn't know, he was sleep. In the video when you can see him kind of sitting, he was sleep. They woke him up out of his sleep and said "You stopped breathing, you got to drink this."'

'How horrible must you be? This is not a prank. This is beyond bullying. You are evil. They are evil.'

SeMarion was in attendance for the press conference last Friday. He occasionally needed to be consoled as he wept while his mother recounted various instances of bullying. 

Cole, the family's attorney, confirmed the family is seeking criminal charges against the teens and their parents, along with any other involved party.

'These are not misdemeanors these are felonies,' she said. 'To call it bullying minimizes the gravity and the horror of this attack.'

Cole continued: 'In my opinion, not only did they torture this kid, but they filmed it and were proud of it and shared it on multiple social media sites making fun of him.'

Speaking to CNN on Wednesday, Smith said she felt 'devastated' after learning what happened at the sleepover, adding she 'cried for a long time' afterwards. 

'In my opinion, not only did they torture this kid, but they filmed it and were proud of it and shared it on multiple social media sites making fun of him,' she said.

As the family press on with their attempts to bring criminal charges against SeMarion's tormentors, Cole said she will also be pushing for the school district to reform how they address bullying and harassment. 

'Right now, what Plano ISD is doing is not working,' she said. 'I'm not certain if the failure is in the policies. I'm not certain if the failure is in the implementation of the policies. I don't know where the failure is, but I plan to get down to the bottom of it and assure that Plano ISD has the appropriate policies and procedures in place to assure our children's safety.'

SeMarion, meanwhile, is said to feel 'empowered' after he held a protest last week and is 'ecstatic' to see so many people showing support for him. He held a sign during the demonstration reading, 'Justice For Me', with a t-shirt bearing the same message.
