 The man charged with killing two Sonic employees at a Nebraska drive-through in November before appearing in a smiling mugshot is now facing additional charges for allegedly stabbing another inmate.

According to court documents obtained by local news station KETV, Sarpy County Jail corrections officers responded to a cell on May 12 to find Roberto Silva Jr., 23, standing over fellow inmate Derick Fuller, who was lying on the ground of his cell.

'He stabbed me,' Fuller allegedly told the corrections officers. 'He shanked me with something sharp and flushed it down the toilet.'

Silva did not respond to any questions about the incident, the documents say.

There is no footage of what happened inside the cell, but witnesses reported hearing screaming and choking.

Fuller, who was arrested in August for aggravated theft, was hospitalized with cut wounds to his ears and neck and required one stitch.

Silva, meanwhile, was moved to a different facility.

He is charged with use of a weapon to commit a felony and second-degree assault, in addition to the charges he already faces for allegedly killing two Sonic employees and injuring two others in November.


According to Omaha police, officers responded to a call about a bomb inside a moving truck at the Sonic parking lot in Bellevue, near Omaha, on November 21, but when they arrived on the scene, they found the vehicle on fire.

About one minute later, the call was updated to a possible shooting, and cops found Silva lying on the ground with his hands spread out, apparently accepting his fate. He did not resist arrest and was taken into custody without incident. 

They also found 22-year-old Nathan Pastrana and 28-year-old Ryan Helbert dead at the scene. Two others, ages 18 and 25, were hospitalized.

Police returned to the suburban scene the next day and determined there was no bomb, and the area was once again safe.

Silva was charged with two counts of attempted murder in the first-degree, four counts of using a firearm to commit a felony and one count of first degree arson.

Police seized four firearms from Silva following the shooting, after already taking three of his guns just a few days before — when he was arrested on suspicion of identity theft, accused of using another person's Sonic app to buy $57 worth of hamburgers and corndogs in four separate purchases from that location.

He was released November 19 after posting 10 percent of his $1,500 bail.

Silva is now due to appear in court in June on these new charges for the alleged stabbing, one week after he appears in court for a hearing related to his November murder charges.
