President Trump’s deputy counsel Patrick Philbin nuked serial liar Adam Schiff on Wednesday for making up bogus charges against President Trump on the Senate floor.
Schiff is no match for Trump’s defense team.
Mr. Philbin is brilliant and has been able to dismantle the Dems’ shampeachment while barely even looking at his notes. Impressive.
Schiff smeared President Trump with allegations of bribery and extortion even though none of those charges were included in the articles of impeachment.
Mr. Philbin said if any prosecutor tried to do what Schiff did, there would be a mistrial.
“No, the articles of impeachment do not charge the crime of bribery, extortion or any other crime and that’s a critical point,” Philbin said citing the Supreme Court which established that issues raised in a trial must have a specific charge.
The Supreme Court also ruled that “a court cannot permit the defendant to be tried on charges that are not made in the indictment against him,” Philbin said. “That is the rule in criminal law and it is also the case for impeachment.”
Philbin continued, “It is the House’s responsibility to make an accusation, and a specific accusation in articles of impeachment. The House had the opportunity to do that and they did that and the charges that they put in the articles were abuse of power on a vague standard that they made up, and obstruction of congress,” he said.
Philbin then dropped a nuke on Schiff.
“They put some discussion in a House Judiciary report,” Philbin said referring to a report Nadler released where he smeared Trump and taunted him with jail time, “that they did not put in the articles of impeachment and if this were a criminal trial in an ordinary court and Mr. Schiff had done what he just did on the floor here and start talking about crimes of bribery and extortion that were not in the indictment, there would have been an automatic mistrial and we’d all be done now.”
“And Mr. Schiff knows that.”
