The Alabama House of Representatives just passed a bill that is a slap in the face to marriage equality. Since gay weddings are to be on equal footing with straight ones, Alabama will make all weddings meaningless.
Lawmakers have decided that Sections 22-9A-17, 30-1-5, 30-1-12, and 30-1-16 of the Code of Alabama should be amended to abolish any requirement that couples getting married obtain marriage licenses — or have even have wedding ceremonies at all. Now, those wishing to marry can just fill out some forms, submit them to the probate office, and emerge as spouse and spouse. Easy peasy.

The bill, which passed 67 to 26, was sponsored by Alabama State Sen. Greg Albritton (R), and has both the Alabama wedding industry and advocates for LGBT rights up in arms. While the law as amended would, in a technical sense, treat everyone equally, the change was clearly made to appease opponents of same-sex marriage.
“I feel like it was born out of prejudice,” said Alabama State Rep. Neil Rafferty (D), who voted against the bill. Rafferty is the only openly gay member of the Alabama House.
Lawmakers who supported the bill included Alabama State Rep. Wes Allen (R), a former probate judge, who stopped issuing marriage licenses in 2015 when the Supreme Court ruled that states must allow same-sex marriage.
Allen reverted to the classic, “I believe marriage is between a man and a woman,” and reminded the press that, in 2006, about 80 percent of Alabama voters approved a constitutional amendment restricting marriage to opposite-sex couples. Allen likened the signing of a marriage license to signing a check – saying, “you’re endorsing it.” Allen chose to made no reference to major legal precedents occurring a decade after 2006 that made same-sex marriage the law of the land.
Never one to put the legal rights of its citizens before discriminatory actions by its government officials, Alabama lawmakers sprang into action. Like a frustrated mom confiscating a toy from arguing children, the state legislature adopted a “Fine, now nobody gets it” system.
The bill now heads to Gov. Kay Ivey’s (R) desk to be signed into law. Governor Ivey has been making headlines of late in conjunction with her support of Alabama’s unprecedentedly restrictive abortion laws.
You may be asking: “Aren’t a whole bunch of people boycotting Alabama over those abortion laws?” and “Won’t eliminating weddings harm the state’s economy even more?”
Yep. That’s right. Some in the wedding business in Alabama worry that the legal change will make their entire industry obsolete.
Wedding venue owner Don Booze explained that under the new laws, “’I now pronounce you man and wife’ will be totally meaningless because that man and wife union happens at the courthouse.”
That’s certainly something of a plot twist.
Until now, it was supposed to be liberals who were hell-bent on destroying the concept of marriage. Wasn’t that what the Defense of Marriage Act (DOMA) was all about?
While Alabama’s legislature was tying up loose ends on its marriage laws, it made sure that teenagers could also benefit from this new no-license, no-wedding system.  Under the amended statute, 16 and 17-year-olds are good to go as long as one parent sends a notarized affidavit to the probate court. Good to know the Yellowhammer State has its priorities straight.

  1. I think Alabama got it right. Who you marry, how you marry, are not a matter for the State to endorse or prohibit. The pomp that goes with many marriages is cultural and won't go away just because the marriage license is no longer required. The gay community, like the straight community, ought to celebrate a truly sane answer to an otherwise divisive legal problem. Everyone is equal.

  2. Bad move. This was the intent behind the pushing of gay marriage. It would create enough backlash to allow this kind of legislation, which in turn allows the forced testimony of your spouse against you.

  4. it's actually less legislation. You Can have any Ceremony you want you just aren't required to get govt permission of a license and fee of course and are no longer mandated to use a govt registered mediator to do the service

  17. Why does one need a "license" to marry when a "license" is just permission to do something ILLEGAL? The State needs to keep its nose out of the private affairs of men and women not employed by the State nor receiving any form of benefit from the same. Marriage is between two people and the Divine creator, not between two people and the State. Get over it. I say all States should adopt the notion of "stay out of my f--kin life!" and discharge the DUTY as charged under Declaration of Independence and Constitution, not cater to "special interest groups" and whinny crybabies.

    The man who is responsible for gay marriage in New York City is rabbi David Saperstein . His wife, Ellen Weiss, was formerly the head of the NPR newsroom, National Public Radio. This is a powerful force and he basically claimed responsibility. He said if it weren't for our group of rabbis, this would have never passed. So what you see is this constant tension for Jewish revolutionary subversive activity and now the homosexual has succeeded the negro as the avant garde of the revolutionary movement in the United States.

    The correct word, 'Lodial', was removed from ALL dictionaries during the early 1940's, but you will find it in early 1800-1900 dictionaries.
    LODIAL = LO = location, DI = original jurisdiction, AL = contract.

  26. What if two men, or two women, who are not homosexuals want to marry? What if they share a home, trust each other with their finances, depend on each other in times of need; they should not marry for the legal benefits?

The only reason homosexuals would have to object to the government getting out of the marriage business is that they looked upon government legalization as a stamp of approval for their lifestyle. However, since they apparently can still become married but without the license application entanglement, what's the difference? Same sex marriage does not necessarily imply homosexuality anyway anymore than it does sexual acts at all. Perhaps marriage of any kind should be erased from all law, included taxes, with it being purely a civilian agreement. Would there be consequences, other than to the legal professions?

  28. ...the bias in this article is terrible. I have a lesbian daughter, daughter in law and a new grandchild. I'm happy as hell for them...but told my daughter when they got the right to marry...that now they are equal to the other slaves. Government should have zero role in marriage. It should be a religious-civil, or simply a civil agreement or contract. No State role.

    But the liberals did destroy the concept of marriage, as far as the law is concerned. Over a decades-long, multi-faceted campaign, they turned its legal image from a sacred lifelong union of a man and woman for the sake of beginning a family, into nothing more than common paperwork with two people's names on it and no expectations, obligations, structure, or purpose. At least Alabama has the decency to admit that, as far as the law is concerned, marriage has become little more than mere meaningless paperwork. Perhaps someday we'll have a government decent enough to recognize that marriage has always been a religious institution (it's a SACRAMENT OF THE CATHOLIC CHURCH, for crying out loud!), and separation of church and state should have barred government from any intrusion into it, or consideration of it, or discrimination of any type on its basis, even from the start of this country.

You get Lawyers and make an agreement through those lawyers with Wills, on how everything is to be divided in case of death, separation, possessions, etc. Good friends, who are not homosexuals have lived together in times past, without the absurd idea of marrying each other.
