This happened in 2014 in the Netherlands. A man from Poland lost control over his car in a small bend on a provincial road (state road?) and ended up on the bicycle path where he hit the girl and her 2 grandparents. The speedlimit was 80km/h and even though the police investigation report says the speed he drove was between 76 and 124km/h, it was not proven he was driving to fast. Also in the small bend of this road where the accident happened it is possible to take the bend with 130km/u. The polish guy also has no criminal record nor was he under the influence of drugs or alcohol or using a phone while driving. So the court said a heavier punishment wouldn't fit in this case.
