A police officer who was charged with murder for shooting an unarmed man in a hotel hallway was reportedly rehired temporarily so he could collect a pension, local media reports.
Philip Brailsford, who killed Daniel Shaver at La Quinta hotel in Arizona in 2016, reportedly came to the agreement last year with the Mesa city manager's office.
This allowed him to apply for a disability pension on the basis of a medical retirement in a reversal of his firing by the department after the shooting.
He will receive a lifetime pension of around $30,000 per year.
The agreement was first reported by local news outlets in Arizona, which obtained the settlement agreement that the city reached with Mr Brailsford last August.
Mr Shaver's shooting captured media attention across the US when it happened in 2016, and again after Mr Brailsford's trial when his body camera video was released.
Police were called to the hotel in January 2016 following a complaint about a man with a rifle in one of the rooms. Mr Shaver, 26, had been showing a legal pellet gun that he used in his job in pest control, to a woman in the room with him.
Body camera footage begins with the confrontation between Mr Brailsford, other officers, and Mr Shaver and the woman. Mr Shaver complies with a series of confusing commands from the responding officers, putting his hands up and lying down on the ground.
They threaten to kill him multiple times for not complying with their orders.
"If you move, we're going to consider that a threat and we are going to deal with it and you may not survive it," one officer says.
"Please do not shoot me," Mr Shaver says at one point, his hands in the air. But Mr Brailsford opened fire after Mr Shaver appeared to reach behind himself while crawling towards the officers. He was struck five times.
Mr Brailsford, who was carrying an AR-15 rifle with the phrase "You're F****d" etched into the weapon, according to a police report, was charged with murder for the shooting and fired from his job soon after.
He testified in court that he believed Mr Shaver was reaching for a gun and would have done the same thing again.
He was acquitted in November 2017 after a six-week trial on both second-degree murder and reckless manslaughter charges.
The settlement notes that Mr Brailsford has been treated for post-traumatic stress disorder. Michael Piccarreta, his lawyer, told ABC 15 his PTSD stemmed from the shooting incident and criminal prosecution.
Mesa City manager Chris Brady told ABC 15 that Mr Brailsford's PTSD claim dates to before his trial.
"So in fairness he was given the opportunity to make that appeal to the board," he said.
The shooting prompted a multimillion-dollar lawsuit filed by Mr Shaver's family, which is still pending.

  2. I remember when this happened, the guy was only wearing boxer shorts and was told to crawl down the hallway towards the cops, he reached down to pull up his shorts, that's when he was shot. No way could he have had a gun hidden. The cop should be in prison.

  5. the public is the moron and the government employees the crooks. The local cops will retire to get their pensions, and then get rehired to collect another check on top of their pension. Also, they will let other in the know long time employees falsely claim discrimination, for sex, race, etc so they can collect money from lawsuits. Everything is rigged.

    It is Time for a National Memorial to Citizen Victims .
    Mandatory Law needed: The Abused Citizen Victim Apology Law:
    Any time the police botch a raid on the wrong house, murder a Citizen for no cause, recklessly injure, kill, a Citizen, and other false arrests where their TAXPAYER FUNDED body-cameras "just happen" to not work, and every other screw-up situation ....... EVERY cop anywhere in the area shall assemble, "Take a Knee" and cover their hearts with their covers in apology. with their cars flashing lights .................... The same actions will take place for Citizen funerals.
    A prominent memorial to be erected in every large city dedicated to the innocent victims of abusive and corrupt police. Annually, a day of reflection and regret. on date (May 26th?) to be determined, there will be a Citizen Victim Day whereupon EVERY cop will assemble at said monument to meditate and reflect on Murdered Citizens and again kneel, doff covers, and pray to God for forgiveness.
    There will be mandatory monthly ethics classes on such subjects as "Negative Effect on Society of Perjury by police" and "Sociatal impact of Murder by police".
    These acts shall be in addition to punitive damages and restitution paid.
    Have you noticed there are no massive funerals with TAXPAYER FUNDED police cars/equipment and TAXPAYER PAID police saluting for the VICTIMS of police MURDERS?
    Where is the recognition and apologies to the VICTIMS of their BLUNDERING???
    Always remember ---- these are the "HIGHLY TRAINED PROFESSIONALS" that the government says will protect you if you just be nice and give the government your guns. Police murder more Citizens every year than do terrorists.
    The cowardice of hiding MURDER behind lies of "resisting arrest" and "I was in fear for my life" should immediately disqualify for life anyone from ever engaging in "law enforcement" . If you are that cowardly you should be a greeter at Walmart.
    Yeah sure, the POLICE - --- Currently, in the U.S., law enforcement kills around 1,200 citizens per year. Ironically, that number is actually four times higher than those who die from rifles. As has been recorded, cops have killed 450 percent more people than have died in the past forty years of mass shootings.
    Judgements of that nature should be taken from the police department retirement funds. Not the taxpayers... When department retirement funds are depleted by lawsuits, there should be no taxpayer funded bailouts.
